Every Market Media, LLC, a Chicago based marketing data compiler as well as affiliates, divisions, contractors and all data sources and suppliers, all of which are referred to hereafter as “EMM” have a an obligation to the privacy of every consumer about whom it holds information. Since we aggregate individual consumer data, we want users to fully understand the terms and conditions surrounding the use of that information. This statement is intended to clarify what information we gather about consumers, how we use it, and how we correct or change it. What personal information does EMM collect?

EMM uses the information it collects to improve your experience with EMM and its marketing service providing clientele, including but not limited to personalized messaging and website experiences. The types of information we may collect about you include:

  • Information You Give us: We receive and store any information you enter on our website and contact page, through registration and other forms, or give us in any other way. This may include your name, the company you work for, postal address, email address, telephone number, marketing preferences and other information.
  • Information from Other Sources: We may receive information about you from other sources. If you provide information to EMM we may collect additional information about you, including information about you from EMM affiliates and other sources.   • Automatic Information: We receive and store certain types of information whenever you interact with our websites. For example, like many websites, we use “cookies” and we obtain certain types of information when your browser accesses our web sites. This may include individual and aggregate visitor preferences, as well as information such as IP address and browser type.

Information Best Practices

EMM, or it subsidiaries, may collect data off–line directly from consumers or from other data collection sources in order to compile acquisition lists of various consumers who may be interested in receiving marketing materials from EMM clients. EMM respects and promotes consumer privacy and is committed to maintaining the balance between the legitimate information needs of businesses and the concerns of individuals and the public at large about fair information practices. In its consumer data collection practices, EMM and all business with whom EMM associates, employ the following fair information practices. Fair Information practices used by EMM and its data providers:

  • Acquisition of relevant and socially legitimate information from reputable sources
  • Taking reasonable steps to assure the accuracy of the information, including permitting individuals to correct inaccurate information
  • Safeguarding data by restricting access to only those who have a legitimate need and right to access the information
  • Taking reasonable steps to protect against the misuse of non-public information
  • Informing customers and suppliers how information is used
  • Restricting offer traffic only to those that offer the consumer value
  • Educating staff on the importance of privacy

Ethical Relationships

EMM pledges to conduct its relationships with both clients and other information providers in an ethical and professional manner and in accordance with Direct Marketing Association guidelines.

Awareness
EMM is committed to education for our clients, employees and suppliers about the importance of consumer privacy and teaching best practice steps for implementation.

Accuracy
EMM maintains strict quality control procedures to assure the integrity and accuracy of our information.

Data Compilation
EMM acquires and licenses consumer data from sources including, but not limited to its own websites and/or through opt-in co-registration from our vendors.

Use of Information
EMM uses any and all data obtained in order to provide recipients with information on products and/or services that may be of interest to them.

Sharing of Information
EMM uses the information described above both for its own marketing efforts, and to help its vendors to better understand the demographics of their target audiences. EMM does provide personally identifiable data to other marketing companies, advertising agencies, data compilers and data companies. Such information may be used to provide consumers with information on products and services that may be of interest.

If consumers in our database have indicated that they do not want to have their data shared with third parties, EMM will limit the use of that person’s data to the suppression, validation and enhancement of existing information held by third parties about its users.

Opt-out/Unsubscribe Policy
By registering with our or our vendors’ sites to receive third party offers, users allow EMM and its affiliates to make their personally identifiable information available to third parties in accordance with the terms of applicable privacy policies. EMM provides users the option to opt-out from receiving email sent by EMM or third party marketers for promotional purposes.

Users may unsubscribe to electronic mailings sent via our internal affiliates at any time by following the instructions contained at the end of every newsletter or emailing. Users may opt-out of receiving further information sent on behalf of third party advertisers by EMM or from EMM sharing information with advertisers or third party marketers for promotional purposes.

Terms and Conditions

Orders are fulfilled with data owned by Every Market Media or a third party supplier. Specific attributes are captured online, from surveys, or modeled by Every Market Media or by one of our suppliers.

Data is rented for one time use only unless specifically approved otherwise in writing on the Purchase Order. However once an individual responds to a solicitation, this limitation no longer applies to that individual record. Every Market Media’s maximum liability for errors or omissions cannot exceed the cost of the data and services purchased from Every Market Media. Every Market Media might require a copy of a sample mail piece, telephone or HTML script prior to the supply of data from Every Market Media or our third party vendors. Every Market Media has the right to refuse an order for any reason.

Every Market Media does not warrant any listings to be TCPA compliant. With the dynamic nature of mobile numbers, any telemarketing done from a automated dialer is recommended to scrubbed real time with a certified TCPA reseller. More information can be found at http://www.tcpacompliance.us/.

Every Market Media does not guarantee that international records purchased are going to be compliant for all campaign use worldwide. Laws worldwide differ depending on the country. It is the responsibility of the client purchasing to research and assure their campaign is compliant with each specific country’s law that they are utilizing the records in.

Every Market Media will replace any hardbounces in excess of 20% on a one to one basis after receipt of a transmission report. Every Market Media is expressly not responsible for email non delivery due to server reputation or malfunction. Every Market Media does not warrant or imply that’s it prospecting records will be allowed on all email marketing software. It’s recommended to check any Email Service Provider being used for compliancy. Conversions, as well as a specific number of opens and clicks are not guaranteed by Every Market Media.

All sales are final. No refunds are permitted. Payment will be processed based on the terms agreed upon in the invoice. Records will not be released to the client until a signature is executed on the invoice and returned to Every Market Media. By signing the invoice, the party agrees to the Terms and Conditions outlined here.
